    Can you please advice on this:
    U mentioned this in ur Survior Guide:

    woman can file a case in any part of India against you. If given an opportunity, she may file in the districts or in another city. If she does that, the harassment factor just went up by 10 times for you. Imagine running around the courts and police stations in a place you have no roots. Also imagine the intimidation you can be subjected to if you need to fight on a turf of her choosing. Think about the expenses involved in travel and lodging. There is a judgment from the Chennai High Court that may help in this situation as it deals with issues of jurisdiction. I have posted it and it may apply in your case.”

    As Im in XXXX and my wife has filed a case in YYYY where they have got lot of political and police influence.

    I N S; my family are the victim of false dowry case pitition by my wife(XX) and his Uncle(Chacha)Mr. YYYY who is A.S.I(Asst. Sub Inspector of Police). He is misusing his power against us.My father is retd. as I.R.S and our family are reputed . Mr. YYYY is demanding so much amount from us and we are not able to give such amount. She was lefted by his father after death of her mother and then she lived with his uncle(Chacha) .But they didnt told this matter to us they told she was lived with her Uncle(Mama)so that we trusted them. Now she dont live with us since 14 month and between this month her uncle(Chacha)always demanding and we reject it. Therefore they filed false case of dowry against us . Her uncle(Chacha) is misusing his power because he is A.S.I of that area where they file the case . Plz anyone help us how can we come out from that problem.

    My neighbor’s son,(40), as we saw him growing up was a soft decent boy.
    This decency is costing him, a lot now due to 498a ipc.
    He is in US since about last 12 years. Got citizenship too. He came down to India ,to attend a relative’s wedding, and married a girl from Bangalore a bit in a hurry recommended by a common friend from Canada.

    Truth is stranger/bitter than fiction. This girl here had
    many men friends some of them hooligans, helping her, to live alone, in Bangalore as she had lost her father at a very young age and motherly after a long illness a few years ago.
    After mariage she wanted to continue friendship with these boys, saying that she had told about this friendships earlier to the boy just before marriage. (But she had also told that she will not continue with them, as she was not married till 35 she was looking for boys and had made these friends).Now she says that they had helped her in times of need. (Her brothers were all married, & lived with their wives in separate houses leaving her alone in their father’s house, little away from city.
    Boy , for having married her, as an obligation tried to calm her and agreed that they can meet her in person accompanied by a third person. This irritated her. And the rifts began, They were more than just friends for her, she said clearly. She preferred them to him..!
    But he had to send about ten thousand dollars, for her comfort and luxury.Viza processing to get her there in US was taking time. Boy was learning the painful truth slowly & quietly. His hurt stopped him from writing letters to her. She also did not apologize. Younger of the brothers asked him to bear with her for sometime & he tried to cheer her up.
    Inspite of all this she suddenly asked for a divorce, Boy thought for a while . His parents in India advised him to give her time to realize. But the eldest of brothers asked for annulment failing which, they could go to the court.
    Divorce papers were sent in reply to her old e mail asking for divorce.
    Suddenly, ipc 498a was bounced upon the boy (in absentia) and his old parents here. In the complaint all possible lies have been written, Dowry harrasment, iltreatment, suspicion on boy’s character, deserting her, (She herself deserted him and left the in law’s house, in two months.)
    Now she denies the e mail, she wrote, asking for divorce.
    Old parents here are in great trouble as she harasses them,making fictious phone calls, made by her friends, false news paper report, by a fictious name.(A reporter in a local paper is one of her friend). sending e mails opened from cyber cafes etc.
    Though God is there to protect the truth in the end, the worry till the cases end in courts is too much for the old decent parents who had enjoyed class I officer’s positions before retirement. with High BP, pains etc of old age.
    Why isnt there any severe punishment for women, who misuse such laws?

    Hi who over you are,

    The article actually is a great survival guide. I have been following a lot of posts on 498a (obviously hence am a victim) and this document if read in time can save a lot of people in those darkely hours of being arrested.

    This article does not cover the LEAD time when the husband is aware that a 498a case may be lodged and he is desperate in salvaging whatever is left of the marriage. I would suggest that it is that time that the husband must ALSO look into accumulating and getting clinching evidences while doing his best to save the relationship. The evidences got in “decent times” adds a lot of value during the case proceedings.

    Also I think the readers would be benifited if anyone could narrate their Indian court experiences (taste of court procedures) from notices being issue, the the filing of the FIR, bail, court summons, dates being postpostned to cross examinations to evidence filing….), filing of divorce petitions, consent agreements etc.

    About me:
    I tried my best in the relationship. A false 498A was lodged against my parents and me. Resisted arrest (had to bribe with political pull..sorry guys to let you down here..but it was a matter of getting my parents out)in the station. Out on bail. Divorce petiotion is lodged by my wife. the Criminal case has not started. The divorce proceedings are on. In the divorce proceeding my sole aim of cross examination of my wife is to arrive at sufficient baseline in the criminal case to prove it as false as the divorce is bound to happen. (how long ???? keep holding on till 498a or till they come for a settlement)

    And i am winning the battle.

    This is a great site for us fellow victims of false 498A and domestic violence complaints. i too was at the receiving end of this when my wife filed 498a against me and my family members. My anticipatory bail was denied in the local court but was granted by the Bombay high court. My wife also filed under the domstic violence act. One of her main prayers is that she be restored back to her matrimonial home, however this too has been resisted since how can a woman who is alleging all kinds of atrocities against me and my family want to come back to that house? She is using my deep attachment and love for my two daughters as the weapon to harass me and strip me of all that i’ve got. I’m fighting it out and I’m sure that truth will win soon.

    Renuka Chowdhry should realise that by introducing bills like the Domestic violence , and the existing 498A , the intrests of the Indian woman are being harmed . Very soon the Indian man will stop marrying and indulge only in LIVE -IN relationships, reducing women to the status of a KEPT WOMAN. will this status benifit /harm the same woman whose rights “this” ENLIGHTENED woman is championing?

    The institution of marriage is based upon compramises and adjustments ONLY. how will it be possible to enter into and sustain a marriage if one party becomes uncompramising and unadjusting ?

    If it is the ‘RIGHT’ of the wife to ask her husband to abandon his parents then she too should be asked to abandon her’s as well. NOW !is the catch——– if a woman can abandon her own parents then what scruples is she made of? Should she be allowed to prowl the streets of the civilised world ?

    Hello Friends,
    The “498” pdf is an excellent document . My wife’s father was a lawyer and we had problems in our relationship after engagement.Unfortunately my parents ignored all her tantrums thinking she was immature and would change during the course of time after marriage.

    She had intention of living apart (separated) from the family to and a burning desire to settle in USA to which I never agreed.
    Consequently she hatched a plan along with her family and moved to USA (she was a software engineer in one of top 5 IT companies of India).

    Immediately after reaching US she told me on phone and she will live separately from family after she comes back from US (after one year).we used to have frequent quarrels over this and one day i along with my family decided to take matter with her parents.

    when we had a meeting with her parents , they brought a henchmen (white collar criminal) that intimidated me and my family to set a seperated household for their daughter (to which we opposed).

    After this she stopped talking with me and when she came back from US after 10 months (she and her family did not inform us that she had come back) straightly files a false 498 A case against us.

    Fortunately I was in US at that time and my family was well connected . we filed for an AB after which the girl’s family agreed for a cash settlement.

    Though I would apologize here that I gave her cash but my parent’s health and my job was at high priority here and I wanted to get out of this mess asap. However i made sure that the cash was given only when they signed the 2 petition for divorce by mutual consent

Some Interesting Stats On Arrests Of Women

In 1930, the British govt arrested 17,000 women for their involvement in the Dandi Yatra (Salt March). During 1937 to 1947 (10 Years), they arrested 5,000 women involved in the freedom struggle. From 2004 to 2006, the govt of India arrested 90,000 women of all ages under 498A. On the average, 27,000 women per year are being arrested under this flawed law. These are stats from the NCRB.
