Woman told to pay Rs 5 lakh to in-laws

In a significant judgment, a local court has imposed a fine of Rs 5 lakh on a woman, who had made a frivolous complaint against her in-laws for dowry.
The Judicial Magistrate said many instances had come to light where the complainants were not bonafide and had been filed with an oblique motive. The magistrate termed the case as a classic example for such an instance.
Kanwalpreet Kaur of Model Town here had filed a complaint against brothers-in-law Davinder Pal Singh, Amarjeet Singh, Satwinder Singh and Gurbinder Singh, mother-in-law Gurbachan Kaur, sisters-in-law Balwinder Kaur and Jaswinder Kaur and niece Ritu under Sections 498-A in 1997. The court had quashed the names of Balwinder, Jaswinder and Ritu from the case in 2002.
Kanwalpreet was married to Navjeet Singh in 1992. In her complaint, she had alleged that her in-laws were harassing her for more dowry. She had claimed that her brothers had given Rs 1.5 lakh to her in-laws in three installments. She had further alleged that she was thrown out of the house.
In the order it had been said the remaining five accused were made to suffer on account of baseless and malicious allegation. To prevent such abuse of beneficial provision of Section 498-A of the IPC by women in future, the magistrate dismissed the complaint and acquitted the accused of the charges.
The court directed Kanwalpreet to pay Rs 1 lakh to each of the five persons.

I have come across similar case . girl due to pre- marital affair wanted to break marraige. she made false allegations against the boy and family. left husband and started living seperatly and was doing job.parents to forcibly keep the marraige lodged FIR under 498A. alaternatively they demanded huge money. when money was denied and girl was asked to come back and start life afresh she came eopenly and mutual divorce was obtained (without alimony). police also tries to take benefit of situation and never investigate. please suggest what legal alternatives we have to punish such people so that this is deterent to others.

I am facing this trauma my self and felt so helpless and was pondering If we can’t change then at least we can raise voice to save few Ram’s and Laxman’s in INDIA.

Dear friend, Don’t be disheartened. 498A is painful in beginning. After the bail you are the king. After 8 months of 498A it becomes painful to woman. Enjoy life forgetting what has happened. Don’t surrender, don’t panic. It certainly cost you money but think it as the punishment of marrying your

You are absolutely correct..My case also same..Initially wife was behaving like a phoolan devi..once bail secured, she came down and begged me to accept her and she ll take the case back..but cannot trust such a girl who leaves her husband house and goes to police station and lodges false complaints n then has crocodile tears..if such woman accepted back in life then it is the most dangerous..remember..first time 498a filed is only 2% conviction rate..but second time from the same lady is 97% conviction..so..to hell with such uncultured beasts..better marry a foreigner if want to…

Dear Friend, in current time some people loosing their life in an accident & natural disaster in early age. Don’t fear for your life. Fight, gather information from Internet about ‘False Dowry case’ and meet to more people who are facing same problem. Write letters to Govt Official i.e. Commissioner of Police, Human Right Commission , PM & President of India Office etc. Don’t be tensed about your ‘social reputation’ everybody knows about False Dowry case. You are not alone. Be mentally strong. After some time problem will be resolved. Believe on God.

Dirty and filthy mind people have discovered a new easy way to make money by marrying their dauthers in well to do families. And after some time they create an issue intentionaly to be separate. I am 31 yrs old , and facing a real problem with my wife , to whom I have been married 3 yrs back without knowing anything about their familly back ground . I am living in malaysia last 6 years , and I married by ensuring the fact that she will not have any problem to be malaysia . After the marriege I came back to malaysia and to arrange everything to for start a new life , but because of some problems I could not arranged everthing properly . As a man I could not cry also .When I asked her she told me I don’t love her . as well as i noticed that she is character who tell lies about peoples to hide her faults or just for fun and everytime I ignored it because I don’t like chaos atall ,But onetime I heard from my parents that her aunties who are politically connected are telling them by telephone that I do not do anything here , they told lies to get me married . So I told her what kind of characteristics she is and told her to get out of my life . But she appolozied to me and promised me she will not lie anymore and begged me to love her by forgetting everything .After that there was no problem between us ,after few days she wanted to go back to india for festival season and come back within 2 weeks .So I confirmed her air ticket and sent her to the airport with lots of gifts for her familly , and rite after land at kolkata airport she start telling about me that I don’t do any job and I beat her up with my belt and wanted back her jewellaries. After I listen to everything I told my dad to file divorce and give her jewellaries , latter I heard that she and her aunties are threatning my relatives on the back infront of her sack . After few days she came with her whole familly and start demanding amount of RS.8000000 from my parents , when they refused to give any money she filed a case of 498a. And last three years the govt of westbengal torturing my parents . But this year she has filed a divorce case by telling lots of lies , which is totally fantasy or which can only be come out from extreamly worse and uncultures peoples . What should I do ?? I am only son of my parents and did not see them almost 3 years because of all these . Hi,
I am an NRI and my wedding took place in UAE under foreign marriage act out of India and so did the divorce as well. I have now been a victim of 498A/406/34 IPC by my ex wife in Delhi womens cell post the divorce. The womens CAW cell Investigating Office has declared this case null and void after I have produced the divorce decree from UAE.
My ex wife has contacts since she works for a law firm in Delhi and she has now approached the lower court and the court has guided her local area police station to release an FIR against her statement and not to arrest me until sufficient evidence is obtained.
This is contradicting the delhi police system where the CAW has stated in her statement that the case is null and void as the divorce was declared and no records of any such malace has been ever registered in the past by her in Delhi and she has absconded from the divorce hearings held in Delhi.
I have now obtained a Interim bail thru my lawyer in delhi which is valid until the end of May and been asked by the judge to attend an investigation at the police station once prior to the next regular bail application hearing scheduled for the end of May.
Is it safe for me to travel in and out of india? please help as i do not want to jeopardize my job here in the UAE.

Hi Guys, I read that some of you are really worked up with false 498As being filed so blatantly. I am also one of you. It has been some time since i am facing this shit. I read that some of you are willing to share the names of the people who have devastated such simple and happy you must have been living, i was living that life too. We are working on something where we would require some details of the ladies who are i this “business” of spoiling lives. We can at least do our bit. Lets make sure that tehy pay in some manner or the other cause our courts just turn a blind eye to these women. Theres no fear in a women to get punished if the cases filed by her are finally proven wrong. Thatnks to this judge who set an example.

I am a victim of 498A, got married to an orphan in 2000, have a kid now 8yrs, she filed 498A in June 2007, coz of extra marital affair with her colleague. left house strated staying separately, she demanded 10lacs, she also took loan on this address upto 20lacs but not paying the installments.
we got divorced in Jan 2008, my kid is with me. she never comes to see my kid. she got married in FEB 2008 & now has a kid. but 498A case still pending.
i want to contest coz all allegation put were wrong & i have enough proof to proove it that ipc 498A is misused.
please let me know whats the process to ensure they get to know whats the after affect of misusing the law.

I have faced a false 498A by my wife Manju Agarwal the sister of Prabhushankar Agarwal of Haldira Bhujiawala (Haldiram Prabhuji). She has thrown me and my mother from our own house. the name i wrote of anita raghavan is the vampire who drank our lives by applying 498a 406 on my family. i am also a sister a mother a wife but i am against this section in practice. it is a dowry harassment to a male. i needs more suggestions who ever concerned and with knowledge to fight back this terror because we are victims of false allegations.

I am also a 498A victim. My wife belongs to affluent “Haldiram Bhujiawala” family and is own sister of criminal “Prabhushankar Agarwal’ who was sentenced to life time imprisonment for attempt to murder for tea vendor. Even criminals and rich people are making use of this law for resolving personal scores and to teach a lesson to husband’s family.

if the case 498a 406 gets khaheeej in the lower court. then our advocate said we are appealing in the sessions court. do we believe that it is on the right path. there were no evidences at all just verbal allegations put on us.

the case has become khareej in the court against my mother. i thought that it will be acquitted becoz we have sufficient data to fight back in the form of bank transactions, photos etc etc still why it got khareej in the lower court. also one more additional along with this the fight for gold ornaments where my mother and the daughter-inlaw anita raghavan maintained a joint locker which was forced to open in front of the police applying this section. but this too got khareej though she demanded it as her dowry. court asked for more documents to prove to achieve where on our side we are able to go further with more evidences to claim it. our vakeel said we are going to fight in the sessions court. i hope we are going on the right path. the main drawback is my mother is aged and a patient and she was taken without any mercy by her with the aid of the police from mumbai to udaipur. i dont want to recollect those moments becoz it develops a criminal mind in me. they could not arrest my brother as he was not here. one thing i realized she would have slow poisoned my parents and killed them and we would not even know about it. she doesnt have a single document that the court should punish any of us. her intention was only money. property, but not to lead and prosper in her married life. 5 years of marriage. 6 months went in completing her MCA course in udaiipur. then went to dubai where my brother had a fully furnished flat for her and every 3 months she traveled 3 times to her place to udaipur just a halt at mumbai for 2 days. then the rest in her udaipur town. the story is a big story. i want to know as per our vakeel told we are appealing in the sessions court. are we on the right track. how we will know that they have appealed in the sessions court.

after seeing the conduct of petitioner that petitioner had not come with clean hands and making false allegation with ulterior motive. Court can refuge to give the relief seeked by petitioner and impose fine or penalty.

I would like ask ms.Anita Mohandas that on Dec 20, 2012 you said that you had enough proofs. so, plz. tell me what kind of proofs i have to collect as i am facing the same false 498a. My brother-in-laws’ wife have filed a false complaint against me and my husband and even I was not at all in touch with them.

In most of the cases of false 498A woman is loser at last if husband has patience. Husband needs some finance and proper guidance. Woman won’t gain anything except harassment of husband with a cost of her own more harassment. Husband comes out as a more strong and polished person. If husband has money power he can come out of the clutches of polices and lawyers. It is the whole life a woman has to repent. Only coward women decide to take help of 498A mostly under wrong guidance. My wife lodged 498A upon me after 20 years of marriage just to settle personal scores. This had nothing to do with dowry. I escaped arrest. I am leading a wonderful life nowadays and ponder over the life I would have led had she not lodged 498A

Women nowadays are taking help of 498A against small issues. Just see this real time video which was taken by husband after false 498A was filed on him.
In the video the woman is hitting herself and abusing the husband with an intention to do more false cases. The law tries to help these women with criminal mentality. But at last the law of the land also cannot defend the false allegations with ulterior motives

He is sending letters and uploading videos blackmailing us to remove all the cases against him.He is trying to defame all of us just so that he can get away with whatever wrong he has been doing to us.Not only is he doing this to blackmail us he is also trying to get public sympathy by misguiding everyone.The man is incapable and has no grounds to defend himself on court and this is the reason why he has been unabashedly spreading rumours and posting letters to our family members and over the internet.
He is very conveniently blaming the judicial system and the corruption as the reason behind his conviction,but no common sense suggests and no penal system is that blind that a man is convicted in almost all the cases pending against him.
We would not have written again had he not recently given indications of killing our mother.He has started posting letters to family members saying that my mother is going to commit suicide soon.This screams out his inner self.He can now stoop down to any level.He is making all plans to physically and dangerously attack us.The police is investigating into the matter but before anything concrete happens from the judiciary side,we earnestly request you to help us.Kindly take whatever strict actions you can from your side.This man is not worthy of anyone’s trust.

Merely filing false cases does not prove a man guilty. Our Indian law system is like that. Being a woman you can file hundreds of cases on a man but you can never prove a false case. Whole world knows how women are taking advantage of 498A. This blog is full of those instances. Please remember if you tell anybody that your mother filed 498A on your father and show that video nobody will take risk marrying you however beautiful you are. You are also there in the video assisting your mother in her wrong doing. Your father never harmed any of the children and he still loves you all. Your mother put false cases on your father. Administration believed your mother and pursued with the cases. Your father never requested you or blackmailed you to remove cases. Your father sent a single letter to in laws to take care of your mother. Why don’t you put that letter over here. That letter was sent officially with his own signature.
People in this forum can see the video and find the truth. The new case u/s 107 which your mother started has no basis. Technique of doing false cases help at beginning in Indian legal system. Later on these false cases fall upon the accuser because they are never going to be proved. Your mother can be charged of doing false cases and doing harassment
You have never talked to your father and blindly believed your mother. Surprisingly when your father came home after getting bails you assisted your mother in doing acting of self assault. Dear friend, How can you call a person cheater without knowing him. He never did any harm or disrespect to daughters and son. The children have blindly taken the path their mother is following. You know 498A is bad law. In this case it was filed after 23 years of marriage to avenge personal scores and get easy money of husband. It is claimed in the FIR that woman’s father who was dead 20 years back was still giving money to husband. This 498A was filed so that the woman enjoys the company of her lover with the money of husband. What else could be the reason? Children are only being used by mother for personal gain. One day when they do realization they will come to the side of father.

In Feb 2013 the husbnd came home and the above video woman and her daughter trapped him and locked him in a room. He was then handed over to police with a charge of attempt to murder (section 307). The corrupted police even saw the video and audio of the incident but still believed on this video woman and her daughter. Husband was in custody for two days. Police, lawyers and courts had grand feast over the hard earned money of husband. These things have now become very open. Nowadays even the daughters are taking part in 498A filed by mother

there were no fightings or shoutings between us….. actually we led a happy life…… but wen i came to my home town on leave and my wife just went to her place along with her brother for 2 days , the story changed…… call from police guys … than court…… than bail….. now fighting hard….. i even got the photographs taken the day before she went to her place with smiling face hugging me….. even the trips we went in just the small period we lived together…… but still the case takes its own time in our respected courts…… so pls guide me …. if any …… i’m really innocent ….. i swear…..

Don’t go for money settlement. I am experienced 498A victim. Settlement can be done later on. At present fight out the case and come to equal footing. Settlement is more of requirement from other party. As long as divorce is not done she cannot remarry.

Dear Sir, my wife and me are married past 7 years and leading a great and a very happy life, we used to travel, used to freak out , used to enjoy life. Just an interference in my every decision from my father in law and mother in law worried me a bit but I thought, this will fade away with due course of time. In 2010 we decided to plan a baby with our mutual consents,by the grace of God , I have been blessed with a baby boy in 2011, I was overwhelmed with the blessings and started concentrating on my kid, the love for my kid was realized by my in-laws and they started again interfering and started convincing my wife that I didnt take care of my kid and a useless husband etc etc, even blackmailing me , threatening me to make my life hell and take my baby along with my wife as she has been in total control of her parents.Last month she insisted to visit her parents place and as soon as she reached there she stop picking up my calls and blaming me for child abuse etc etc. Even my mother tried to contact her grandson but her parents didnt even pick up our phone calls. Now, kindly guide me the proper ways to proceed as to get my family back as, as a father I understand that my son loves both his parents and has to stay with father and mother both. Kindly guide me the procedure and my rights as a a father. Also my wifes parents has stayed apart for 21/2 years after her birth and filled divorce but sonme how patched up for certain reasons.

1. Please ask you wife what she thinks is best for the child.
In a calm and peaceful manner, explain that every child needs a father and mother. Otherwise the child will have difficulty with emotional understanding and will not treat her well in the future because of the example that he is seeing now. His play friend “You” or anybody being taken away will make him think that he cannot trust his mother and will create a deep wound in the child how much ever it may be concealed.
2. Think of all the good times and remind her of the same in the last 7 years. Then ask her what changed since the birth of your son? Please ask with respect and without any angry words or angry tone in the voice. Many women after giving birth prioritise their children first and then the husbands and other family members. May be nature is designed this way. Ask her if some godly force took her child away, how would she feel? Please then inform her how sad you feel.
3. Inform her that you respect her first and will very much be grateful if she could respect you in the marriage first. Whether it is your parents or her parents, they only come afterwards in a marriage for it to be successful. But that does not mean that one show any less respect to all parents. Slowly once more trust is built ask her what her reaction would be if she were in your place for the the same questions that your in-laws impose. Use different words to prevent a fight or argument.
4. Please go to a marriage counsellor in your area. Effective communication is important from both parties to convey one’s thoughts without anger or hate. Women and men talk and think differently and this often does lead to major differences, arguments and strong disagreements.

My brother is about to trapped again in the same 498A… My sister-in-law committed an adultery with a boy now after being caught up she is begging for the mercy though its crocodile’s tear, we dont want her to come in again in our life but her parents are threatening us for Section 498A.
We have two options left, either face the false case on us or accept her again with her adultery nature. We have got some of the evidence of her adultery but afraid of false 498A to proceed further.
Really seeking for the helpful advice that may get us rid out of it.
