      Dear Shri Saravanan.v

I have the exact same situation as you! And would deeply appreciate if you could provide any help. Can we discuss on the phone? or would you be comfortable providing details of your quash petition.

My wife has filed 498A and DV case, and there are differences in the two complaints. The DV case has “new” cruelties which are absent from the 498A case.

I would really appreciate your response.

      Many thanks and warm regards.

This is fantastic and thanks for sharing. My wife has claimed outrageous amounts of over a lakh per month – this is nothing but extortion at its best – and legalised at that !! Surely the laws in India are crappy.

    Hi,

I am an NRI and my wedding took place in UAE under foreign marriage act out of India and so did the divorce as well. I have now been a victim of 498A/406/34 IPC by my ex wife in Delhi womens cell post the divorce. The womens CAW cell Investigating Office has declared this case null and void after I have produced the divorce decree from UAE.

My ex wife has contacts since she works for a law firm in Delhi and she has now approached the lower court and the court has guided her local area police station to release an FIR against her statement and not to arrest me until sufficient evidence is obtained.

This is contradicting the delhi police system where the CAW has stated in her statement that the case is null and void as the divorce was declared and no records of any such malace has been ever registered in the past by her in Delhi and she has absconded from the divorce hearings held in Delhi.

I have now obtained a Interim bail thru my lawyer in delhi which is valid until the end of May and been asked by the judge to attend an investigation at the police station once prior to the next regular bail application hearing scheduled for the end of May.

Is it safe for me to travel in and out of india? please help as i do not want to jeopardize my job here in the UAE.

Regards to all my well wishers.

      1) They can make false charges, you can’t stop them from doing this.
      2) Stay in Nepal ask for copy of FIR if any through your relative or lawyer
      3) They can’t do anything to you until unless the MEA is involved and MEA will not be involved until she can prove the charges.
      4) They can make charges against you relatives too but usually not to the distant relative.
      5) Red corner notice is issue against terrorist so that it can limit the travel option, they can caught them while existing from airport. Interpol issue the red corner notice

I’ve been browsing online more than 4 hours today, yet I never found any interesting article like yours.

It’s pretty worth enough for me. In my opinion, if all website owners and bloggers made good content
as you did, the internet will be much more useful than ever before.

Some Interesting Stats On Arrests Of Women

In 1930, the British govt arrested 17,000 women for their involvement in the Dandi Yatra (Salt March). During 1937 to 1947 (10 Years), they arrested 5,000 women involved in the freedom struggle. From 2004 to 2006, the govt of India arrested 90,000 women of all ages under 498A. On the average, 27,000 women per year are being arrested under this flawed law. These are stats from the NCRB.

The family of the writer was tortured by the Indian Police in an attempt to extort over a $100,000 by holding them in custody for over a week. The police, in cahoots with the magistrate and the PP, did this due to the ridiculous allegations made in a 498A case by his embittered ex-wife. She filed the case years after he and his family had last seen her. Thousands of 498A cases are filed each year in India by women seeking to wreak vengeance on their husbands and in-laws. Enormous sums are extorted from intimidated families implicated in these cases by corrupt Indian police officers and elements of the Indian judiciary.
