    gender biased law in india destroying indian families. DV act , maintenance u/s 125 crpc , dowery act are the weapons provided by indian law to women to use them when ever she feels appropriate , in course to harass her husband and his family or to get divorce easily whenever she wants or to extort money from her husband. But when ever man wants divorce from his wife because her cruelty or incompatiability of natue or other reason what soever is imposible in indian law because of these weapons in hands of indian women except mutual consented divorce u/s 13B.When ever husband asks for custody of his children/ child then indian law favor women by saying that mother’s lap is just like ‘child is in hands of god ‘ and duty of man is to provide economic help to wife for upbring of child and every right is given to indian women without any duty and every duty is given to man without any right.

    Topic child custody——as per GWA 1890 and Hindu Minority & Guardianship Act 1956 Hindu father is recognized as legal guardian of male and unmarried female child in preference to mother. While considering the custody of child the paramount consideration is welfare of child. Child below 5 year of age (tender age) is preferably given to mother if child is residing with father as considering the welfare of child and without asking interest of child and saying there is no question right on child as mentioned in Indian law. When child crosses 5 year of age and time come to return the child to father then again welfare of child is again with mother as considering previously ignored factor interest of child and considering the interest of child as welfare of child.
    If mother is economically sound (employed) then welfare of child is with mother and If father is economically sound and mother and child depends on father by taking maintenance from father then economic condition of parent is not deciding factor but paramount consideration is welfare of child which again lies with mother as mother can provide more love and affection to children .ultimately child will be handed over to mother by ignoring the major plus points of father and high lighting minor point of mother

    21st May –‘World Anti Terrorism Day’

    20th May — ‘Indian Anti Legal Terrorism Day’ as Hon’ble Apex court gave Judgment on 20th May 2005 and termed ‘498a’ as ‘Legal Terrorism’ in Sushil Kumar Sharma vs Union of India :JT2005(6)SC266 ; 2005(3) RCR (Criminal) 745.

Some Interesting Stats On Arrests Of Women

In 1930, the British govt arrested 17,000 women for their involvement in the Dandi Yatra (Salt March). During 1937 to 1947 (10 Years), they arrested 5,000 women involved in the freedom struggle. From 2004 to 2006, the govt of India arrested 90,000 women of all ages under 498A. On the average, 27,000 women per year are being arrested under this flawed law. These are stats from the NCRB.
