    THIS SECTION 498A IS MISLEADING SOMANY INNOCENT PERSONS AND SPOLING THEIR HAPPY LIFE.THEY DEMAND HUGE AMOUNT OF MONEY AND HARASSING WITHOUT MAKING ANY MISTAKE.
    THE LAW MUST CHANGE REGARDING THIS SECTIO,.INNOCENT PERSONS ARE SUFFERING TOO MUCH.
    THERE IS NO INQUIRY OR NOTHING JUST ON GIVING A SINGLE COMPLIANT ALL THE FAMILY MEMBERS ARE ARRESTED,THIS IS NOT THE GOOD WAY.

    IAM ALSO THE VICTIM IN THIS CASE,I APPRECIATE THIS WEBSITE FOR COOPERATING AND ASSISTING FOR THIE 498A VICITIMS.

    Hi,

    I am going thru the worst time of my life. My wife has falssely implicated me in a 498, 323 & 506 case. The police have registered the case without trying to find out the truth. Quite frankly, I am a victim of illegal use of available law by a deceitful wife and careless police action.

    Please send me the copy of this dismissal. I would like to learn from it to deal with my difficult situation.

    I would be labeled a low-life, chauvinistic gutter rat if I stated, “There’s certainly a place for punitive sanctions per IPC §498A, and it’s down the commode”! So I’m not going to say it! No Sir!

    Ironically, the law was formed to put a check on marital extortion rackets once openly widespread as a National Cottage Industry where only the groom and his family stood to profit: an evil monopoly! And now, IT STILL IS a Cottage Industry of sorts but, in all fairness, the profits have shifted towards the bride and her family with a justifiable “cut” going to the Commision Agents: the Criminal “Justice” System! And a prime source for generating ongoing profits? The visiting, disillusioned NRI!

    You see, in a true democracy, the majority are kept happy! Ahhh … Free Enterprise at last! Jai Hind!

    “But in the interest of equity, how can the minority find some semblance of relief”, you ask? The solution is very simple provided you have what it takes, i.e. COURAGE TO TAKE A STAND.

    When, during the course of your trial, it is discovered that your accusers lied and our Liars in Uniform doctored incident reports, vehemently move the court to prosecute them for perjury. There still might be some judges around who view perjury as a criminal act to impede the discovery of truth, an act contemptuous toward the judicial process itself. When the courts take a stand against such commonplace lies and see it as tantamount to difficating on the Bench, they will send a clear message to other prospective IPC §498A opportunists (including the uniform-wearing variety) that there’s a heavy price to pay for clogging up our already clogged court system with bogus claims!

    But on the other hand, you can always “Compromise”, i.e., grab your ankles and hope it doesn’t hurt. In which case don’t bitch about the status quo, just ride the waves and let the disease continue festering.

    My son, wife, mother-in-law and self have been implicated by a very coniving family. Accuastions are as in all cases lies, In a trial they will not stand the test of truth. Yet for now, we are going through a trauma. Thanks to a peice of legislation which was concieved very myopicaly. The accused have to endure and then fight. But you need al ot of resources and influence. There must be punitive action against the appelant also. That along with a law to restrain the police could bring fairness.

    hi, my friend has got married before 15 years. but his wife had left him and went out of his home after one year of their marriege. since then she is harrasing him by filing the false cases on hi. undre sec.498a. and now though she is not living with him and getting a mentainance of rs.2000 per month, she has filed one more complaint against him under domestic violence act 2005. if any case laws relating to in favour of husband judged by the supreme court or any high court, you have then please help me by sending it to me. on my email ID. { vikram.undre@gmail.com }

    Kindly send me citation details of quashing 498a, 406. I am suffering for the last 15 years. Even one prosecution witness statement and cross examination has not been completed till now (more than 15 years).
    Multiple cases have been filed against my family members and me.

    Sir,
    My sister who is a Scholar ( MA first class 2nd, Mphil 1st class first, doing PhD) and Sr. lecturer in govt. college had married since 2000 to a guy B.Com, LLB. Since marriage her husband has not contribute anything to family and towards her daughter (7 yrs old), so fromm 2007 onward my sistre has stopped to spend amount on her husband. Apparently he don’t work, although if any source of icome her husband have, its not known to my sister. As my sister has terribly tried to kep the relation, but in vein, she need divorce, but her husband don’t want so. We don’t want to use 498A etc. But not getting a way out also. He also wants to keep custody of baby girl child and ask her to go out of home without taking anything from house. He has also thrashed my sister some time, for which my sister complained in police two years ago.

    May I request you to show light for an amicable solution. Any mediation between families has also been failed.
    Can you send details about Domestic violence act 2005 also.

    Hi,

    I am going thru the worst time of my life since Year 2002 when i got married. i tried to save my married life by convincing my inlaws, but there approach of leeting our familly down and mallacing image nevers stopped.

    My wife left our house on 7/08/03 & has falsely implicated my parents, myself, married sister & brother with 498A, 125 case since 2004.

    Myself along with my old father ( age 69 years) & mother (age 65 years), married sister, Professional brother is tring to resolve the cases since past 6 years. Quite frankly, I am a victim of illegal use of available law by a adamant wife.

    I had tried to solve this issue after aggreeing to meet there demand of 3.25 lacs, which i apaid to her lawyer but she refused to turn back after we paid ammount. Some how we managed to get back the paid amount.

    Please send me the copy of dismissal of 498a, 323, 506(2).
    I would like to learn from it to deal with my difficult situation.

    I want to save my parents, brother & sister to go through the bad & painful experience which they are passing through

    hi, my friend my uncle has got married before 9 years. but his wife had left him and went out of his home after one week of their marriege.she was not coming to my home & after 2year she was became pregent & born a male child after she was come to my home but my uncle not accepted as wife then she is harrasing him by filing the false cases undre sec.498a in the year 2004 we asked from court for DNA test but pittion is rejected now on decissin and now mentainance case she has filed.

    hi, i am from hyderabad india working in USA. i got married in Aug-008. recently my parents, younger brother and I became the victims of 498a. i filed annulment in Feb-2009 and my wife filed false 498a in Aug-2009. She did not sign the FIR. i heard FIR must be signed otherwise it is not valid. right now we all r on anticipatory bail. we have recently filed 498a quash in high court of AP. can someone please tell me whether we can quash 498a on the following grounds:
    1. FIR – not signed
    2. Annulment was filed in Feb-2009 and 498a was filed in Aug-2009.

    i came to india in jan-2009, dropped her at her home (with her parents), filed for annulment in the family court in hyderabad and left to USA in Feb-2009. since then i did not contact her and she is living with her parents.

    please help me and kindly send me 498a quash judgements if you have any on the above grounds. this wud be a great help. thank you so much in advance. my email id is chaithu45656@yahoo.com

      i saw blog, this for my brother, lives in us, he got married in 2005, the girl came, she did not like, things the way here, she came with very high expectation of living in mansions and parties of night clubs. any way long stroy short, she left in october 2008, now her and family are calling my brother thretning, for money for 65 laks, she filed abuse, dowry everybody in the family. he is looking for lawer in india to proceed, if you could give us any info regar with, would be greatly appreciate, thanks,

In 1930, the British govt arrested 17,000 women for their involvement in the Dandi Yatra (Salt March). During 1937 to 1947 (10 Years), they arrested 5,000 women involved in the freedom struggle.
