Advocate Pradeep Nawani Nails The Wife, The In Laws And Corrupt Cops

Adv Pradeep Nawani has shown us the way on how to go about nailing the scum that infest the ranks of the Indian police and has also shown us to how to nail the bitter half and her enablers under Dowry Prohibition Act Section 3 (DP3).

NEW DELHI: A Noida court has ordered police to book a woman and her parents for giving dowry. The chief judicial magistrate (CJM) of Noida ordered the police to register an FIR against Noida-based call centre employee Natasha Juyal and her parents under section 3 of the Dowry Prohibition Act (DPA) for giving dowry. The CJM also ordered action against police officers who refused to register Natasha’s husband Namit Juyal’s complaint.

Giving or taking dowry is a criminal offence under Section 3 of the DPA with imprisonment. This is a rare case where the section was evoked against a woman and her family.

Namit’s lawyer Pradeep Nawani argued that Natasha had not only accepted to giving dowry, but also submitted a list of stridhan that was not as per the DPA. Even her claim of huge wedding expense did not match her father’s financial capacity.

According to Nawani, Natasha filed a complaint of dowry harassment in Noida’s sector-20 police station last year, saying Namit was given Rs10 lakh as dowry in 2005.

The Noida police arrested Namit and packed him off to Dasna jail in UP. After getting bail, Namit sought information under RTI from the Noida police, seeking to know on what basis he was arrested.

He was horrified to hear that he was arrested on the basis of his wife’s mere written complaint and verbal statement with no records to back her allegations. He then asked police to register a complaint against his wife and family for giving dowry.

On refusal by the police, he approached court to get a complaint registered against his wife and her parents. He also sought contempt of court action against the police for failing to comply with a supreme court order, stipulating that refusing to register police complaint by a husband in a dowry case is tantamount to the contempt of court.

    If the intent is to stop the social menace of Dowry then both givers and takers must be booked simultaneously. Bride’s parents cannot go away scot free for promoting Dowry and yet demand that the takers be punished. If the husband’s family is convicted then the bride’s family must join them in going to jail for the illegal activity. On the other hand if the allegations are proven to be false then the husband’s family must be liberally compensated for the time, money and associated defamation and damages.

    Yes. I too suffer from wife and in-laws threatening, who are living presently at Delhi, in a different manner on a regular basis, in order to swindle our hard-earned income and property, by misusing newly formulated laws specially designed only for women. The law makers fully forgetting the constitutions article 14 which says all men and woman are equal before law or say equality before law. This article 14 giving equal strength to man and woman but formulating new law for women so for no law formulated by the law makers for men. Why?
    Which only resulted in iron hand cuffing like a herded criminal and lying in illegal custody. I had been caught by the police on 29th Jan 2009, and kept for two days in police lockup and six day in Correctional Home, Tihar jail and released on bail. She filed false FIR’s and filed under section 498A, 406,506,323 & 34 IPC against me & my family members (my patents, 2 brothers and 1 bhabhi).we all got the bail from the Court of Judicial Magistrate at delhi on 5th Feb,2009. Now, no one here to help me from this day to day harassment, lost couple of good jobs.
    Kindly provide me all the documents and also guideness or advice.

    Sir, One important point in our fight against misuse of Secton 498S is to request for die-detector, narco-analysis and brain mapping of both the complainant and the accused. For, when this draconian amendmenet was brought about in the early 1970s, investigative tools like lie detector, narco analysis, etc. were very much in its infancy, and not seldom ued. Now, it is under use, in major cases like that of Karim Telgi, terrorists, etc. One method of keeping false complainants at bay is to give the option of asking for lie detector test of both the complainant and accused. At the time of FIR the complainant should give her consent to undergo lie detector; she can also demand a similar test on the offender. This, in my opinion, will put the fear of God on both. The suggestions made by Justice Kapoor, unfortunately, does not include this, may be because it falls under CRPC and not IPC. However, civil society can plead to the Law Minister (hopefully Bharadwah) to allow this.

    Please intimate the opinion of the legal fraternity on my suggestion.

    welldone pradeep nawani. a great job done by you .U created a history. please send me if possible the fir copy namit v/s natasha u/s 156(3) $ other order passed by metropolitan magistrate neeraj gaur observe that giving dowary was a cognisable offence and directed the SHO of model town police station to register an fir. this order printed from THE TIMES OF INDIA NOW, Bride and kin in dock for dowry DATED 7 JUN 2009.and the phone number of the advocate Mr. pradeep nawani.

    There should be provision of Camera Recordings as well – In Police Stations and More Importantly Courts – At times rather most of the times There are many things said verbally by the Complainant and vested interest advocates/Parents/Near and Dear Ones to Prejudice the Court- Mislead the Court; without any written statement.; against the husband and his family members. If Camera Recordings are available;One can take up – as to how Misleading False Oral Statements were made, how the husband was not heard in the Police Station and How the Submissions made by husband was not heard/considered during court proceedings….

    Hi Dear All,
    Mr. Nawani was my legal advisor and because of his greed for money i was jailed for 2 days in dasna jai gzb. My case 17th month of Mutual divorce petition and then 125 and 498A,323,504 and 506.

    so please be aware. It is all about money call me and i can tell 9959728628. I know after some days this will also get deleted by the owner. Hence dont judge everyone because of blog.
