RTI Request to Get A Copy of DCP’s Order Authorizing A 498A Arrest in Hyderabad

The MV Krishna Rao order was issued a decade ago, yet Hyderabad’s police officers arrested thousands of people accused in 498A cases since 2002. The cases of those who were arrested are still crawling to conclusions through the sluggish Indian court system. For those who still have the stomach and the stamina to fight back, it is worth the effort to file an RTI to get a copy of the DCP’s order permitting an arrest. If the order does not exist, then it is weakens the case and makes it easy to file a quash petition, as well as bring the malfeasance of the investigation officer to the attention of the DGP of AP.

    In order to avoid this
    , police ask the women to file a PCR and then get an arrest warrant from the court. They do not need DCP’s approval for this.

      I believe you’ve already “worked at it”, and, I might add, successfully! You see, Police Procedures are on the same platform as Regulatory Law; thus, are annointed with like recognition, as other Regulatory laws, and carry the same severity of enforcement “bite”. I came afross a citation somewhere. I think it had something to do with an adverse action proceedings in the UP or Punjab Polic to thise. I could get back, time permitting. Now if the hon’ble court pleads innccence. You might wany to Google it.

    My brother works in Vijayawada, his wife is not staying with him since marriage. She stays at her Father in law house, after four years my brother has left his job since his wife is not cooperating to stay with him. Now he is job less and she is routinely abusing him for money she has stolen all his documents, certificates and passport and blackmailing him. Additionally she has called her father and brother to beat him up by claiming false reasons, many times they attacked my brother and abused all our family members. In frustration and depression my brother has left home, his number is switch off and we don’t know his whereabouts. Now she has filed 498A, 406 and 4 & 6 DP Act against me, my 2 brothers, parents and my sister.

    We have received a notice from WPS saying that the above cited case is registered against us and we need to present before them with in three days with all the ID proofs and Passport Photo’s.

    Seeing the notice we have followed to WPS and approached SI, he has asked us to wait for some time. My mother is ill and she felt unconscious at WPS, later SI told my brother and sister to take her to hospital and he took me to the inspector.

    Inspector was asking my where is my missing brother, I have told I don’t know his whereabouts he is not in contact with me since 5 months. Inspector was putting pressure and threatening me tell the details, since I don’t know his whereabouts I have told them when he comes in contact with me I will update you. They keep me waited for 6 hours in the WPS and released post that and warned me to come every day and need to stay 6 to 8 hours in WPS till such time my missing brother comes in present of them.

    Very next day of this incidence my brothers wife came to home and beaten my sister badly, when we have called the police she went to that police and said some thing later another team of police vehicles has come to my home, they were abusing all my family members and threatening all of us. That police was not making the fair investigation they were completely favoring her and abusing us.

    Police took all the females folks of our family members to PS, there were no female Police involved in the investigation and there was no female police in the PS.

    They have not taken the complaint given by us and they have booked the petty case against us and released all the female family members of my family in the night hours of 10.30 pm.

    My parents are completely depressed, I have given the complaint to DCP and ACP about the above situation. Till now there is no action against the Police and my brothers wife.
